Marvell 88MW300 QFN-68: Confirmation as non-adaptive equipment under EN 300 328 V2.2.2

In order to clarify our status for regulatory compliance, I would like to receive confirmation that the product derived from Marvell 88MW300 QFN-68 is a non-adaptive equipment under EN 300 328 V2.2.2.  To be more specific, related product is Azurewave AW-CU300 IEEE 802.11 b/g/n WLAN Microcontroller Module:

• Adaptive equipment is capable of using an automatic mechanism which allows the equipment to adapt to its radio environment by identifying other transmissions on the operating frequency.
• Non-adaptive equipment does not use such an automatic mechanism and hence is subject to certain restrictions with respect to using the medium (see clause 4.3.1.6 and clause 4.3.2.5 for Medium Utilization factor) in order to ensure sharing with other equipment.

To whom it may concern:

For your information, we are currently manufacturing Wi-Fi Adapter with Azurewave AW-CU300 Wi-Fi module based on Marvell 88MW300.

We are now planning to carry out RED certification testing in Europe and would like to check availability of a SW tool to manually set the Wi-Fi channel, bandwidth, bit rate, etc. as part of this RED testing for Wi-Fi Adapter.

If possible, could you please help be more specific about your reasoning?  Based on which specific information from the Marvell product datasheet were you able to make this judgment that it is adaptive instead of non-adaptive?  Thank you in advance.
