RTC registers dont function if SuperCap drained? (MCF52210)

Hi, I'm using the M52210DEMO board and the RTC in the processor runs fine, but when the board hasn't been powered in a long time and then is powered the RTC clock just doesnt work.  Values can't even be written to the registers.  The only thing I can think of is that it has to wait for the Supercap to charge.  Because after active for I donno 10 mins the clock begins to run again.
 
Anyone know how to prevent this?

yea I just discharged the SuperCap and ran the debug to look at the registers and they are not changing and can not be written to.  So when the Supercap is drained it is causing the RTC to stop functioning.  Anyone know how to get around this?
