MPC8270 Patch Prerequisites

We are about to migrate from MPC8260 to MPC8270. We plan to use the microcode patch that needs to be included for the MPC8270 to resolve ethernet related issues. Is there a prerequisite for the patch to be applied? example FCC driver to be started before patch to be applied? or can it be applied as soon as processor is out of reset.

The microcode patch can be applied as soon as processor is out of reset.

Is there a way to find if the patch is running or not?

Other than inspecting internal RAM address where it is loaded.
