The LPCXpresso IDE is free and uses gcc. Read the Getting started to see how to use it:

The *compiler* has no limit.
The *debugger* has the 128k limit.

And it keeps doing the upload to the board even if the code exceeds the 128Kb limit?

If the communication protocol of the LPC-Link was free and open there is no such limit. So it is not free nor open. :D
